hereinafter referred to as "Forrest & Love." These General Terms and Conditions become part of the contract you enter into with Forrest & Love upon your acceptance. These Terms and Conditions are valid from January 1, 2020.

2. Validity of the General Terms and Conditions (GTC)

These Terms and Conditions apply to all products offered by Forrest & Love in its online shop. By placing an online order, the customer agrees to these Terms and Conditions and is bound by them. The version valid at the time of contract conclusion shall prevail. Deviations, conflicting, or supplementary Terms and Conditions, even if known, shall not become part of the contract unless their validity is expressly agreed to by Forrest & Love.

3. Responsibility, conclusion of contract and accounting

  1. Forrest & Love is responsible for articles, motifs and the design of the webshop.
  2. The offers in the online shop are a non-binding invitation to the customer to place an order and purchase. All offers are subject to change.
  3. By submitting the completed online order form, the customer submits a binding offer to conclude a purchase contract. Receipt of this order will be confirmed to the customer immediately; however, this confirmation of receipt does not constitute a binding acceptance of the order. The contract is only concluded upon acceptance of the order, at the latest when Forrest & Love ships the ordered product. Forrest & Love reserves the right to refuse acceptance of the order due to lack of availability of the ordered goods.
  4. In fulfilling the contract, Forrest & Love expressly reserves the right to deviate from the descriptions, representations, and information in electronic documents, flyers, catalogs, or other written materials regarding color, dimensions, weight, design, and other similar characteristics, provided these are deemed reasonable for the customer. Forrest & Love defines "reasonable" as customary variations due to technical production processes, such as minor dents, minor scratches, minor engraving errors, or minimal defects due to manual processing.

    The customer agrees that invoices may also be created and sent to him electronically.


4. Cancellation policy - Start of the cancellation policy

Consumers have the following right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. To exercise your right of withdrawal, you must notify us (Forrest & Love GmbH, Vilniusstrasse 6, 80992 Munich, Germany, email: info@forrestandlove.de) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or email). To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us (Forrest & Love GmbH, Vilniusstrasse 6, 80992 Munich, Germany) promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning.

5. Prices and payment terms

Unless otherwise stated, when ordering through the Forrest & Love online shop, the prices listed on the website apply exclusively, including statutory VAT. Additional costs such as packaging, shipping, and insurance are not included in the prices and are borne by the customer. Prices are in euros. Discounts, rebates, etc., require an express agreement.

The buyer's obligation to pay the purchase price in full arises upon conclusion of the contract. Payment is deemed to be timely if the amount is received by Forrest & Love or credited to Forrest & Love's account on the due date.

The customer can generally pay the price via PayPal or credit card. We reserve the right to exclude certain payment methods. This may depend, for example, on the order value and the region to which the goods are being shipped. If payment is made in advance, the goods will only be sent to the customer after the invoice amount has been paid in full.

When processing the payment transaction, Forrest & Love is entitled to engage the services of trusted third parties. This means, in particular, that in the event of a customer's default on payment, Forrest & Love may assign its claims to a debt collection agency and forward personal data necessary for payment processing to that agency. If a third party is involved in the payment processing, payment is only considered made for Forrest & Love when the full amount has been transferred to this third party in accordance with the contract.


6. Late payment interest, reminder and collection fees

If the payment deadline is exceeded, the buyer will be charged default interest at a rate of 5% per annum. Forrest & Love reserves the right to prove and claim higher damages for late payment from businesses.

7. Delivery/shipping, transfer of risk and retention of title

Delivery will take place within 21 days (3 weeks) of receipt of the order. However, the goods are usually dispatched to the customer within 7 days.

The goods sold by Forrest & Love are subject to collection. However, we will arrange shipping at the buyer's request for a separate payment. Delivery will be made by a shipping service provider chosen by Forrest & Love. The buyer will be responsible for a flat-rate delivery fee, which depends on the order value and delivery location. Current shipping prices can be found at www.forrestandlove.com.

Delivery is normally within the European Union. Forrest & Love reserves the right to deliver to countries outside the European Union. Any import duties are to be borne by the buyer.

If delivery of the goods is not possible within three weeks, Forrest & Love will notify the buyer of this no later than the expiration of the deadline. The buyer then has the right to withdraw from the contract, which they must notify in writing or by email.

The goods remain the property of Forrest & Love until the purchase price and all other costs and expenses have been paid in full.

Until ownership is transferred to the buyer, the buyer undertakes to treat the goods with care.

If the customer is a consumer, the risk of accidental loss and accidental deterioration of the goods shall pass to the customer upon delivery of the goods. This also applies in the case of a sale by dispatch. Delivery shall be deemed to have occurred if the customer is in default of acceptance.

Deviations


For custom-made items, the color values and design references specified in the order confirmation apply.

Custom-made items are non-returnable and cannot be exchanged.

Custom-made items must always be paid in full in advance.


9. Warranty

Information, illustrations, drawings, technical data, weight, dimensions, and performance descriptions contained in flyers, catalogs, circulars, advertisements, or price lists are for information purposes only. Forrest & Love assumes no liability for their accuracy. The information contained in the order confirmation (shipping confirmation) is the sole determining factor regarding the type and scope of the delivered goods.

Liability for defects is governed by statutory provisions. Should the goods delivered by Forrest & Love be defective, the customer may, within the framework of the statutory provisions, demand, as subsequent performance, the removal of the defect (repair) or the delivery of a defect-free item (replacement delivery). Forrest & Love may refuse the type of subsequent performance chosen by the customer if it is impossible or only possible at disproportionate costs. If the statutory requirements are met, the customer has the right to withdraw from the contract, reduce the purchase price, or demand compensation.

Forrest & Love will cover any shipping costs incurred in the event of a return due to defects. However, the customer is obligated to avoid unnecessary costs by selecting the appropriate shipping method.

Forrest & Love assumes no liability for the constant and uninterrupted availability of the online service.


10. Damages and product liability

Customer claims for damages against Forrest & Love GbR., as well as the legal representatives and vicarious agents of Forrest & Love, are excluded. Excluded from this is liability for damages resulting from injury to life, limb, or health resulting from a breach of duty for which Forrest & Love or a legal representative or vicarious agent of Forrest & Love is responsible. Furthermore, the limitation of liability pursuant to Section 9, Paragraph 1, Sentence 1 does not apply to other damages resulting from an intentional or grossly negligent breach of duty by Forrest & Love or a legal representative or vicarious agent of Forrest & Love. Furthermore, the limitation does not apply to damages resulting from the breach of essential contractual obligations (cardinal obligations) if Forrest & Love or a legal representative or vicarious agent of Forrest & Love is responsible for them. Essential contractual obligations are obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely.

Liability under the Product Liability Act remains unaffected.

Forrest & Love GbR. is only liable for its own content on the website. To the extent that Forrest & Love provides access to other websites via links, Forrest & Love GbR. is not responsible for the content contained therein.


11. Formal requirements

Declarations and notifications addressed to us by the customer – with the exception of notifications of defects and declarations regarding data protection – must be in text form to be legally effective, including an original signature or a secure electronic signature, and must be addressed to Forrest & Love GbR., Vilniusstrasse 6, 80992, Munich, Germany. The contract, order, and business language is German or English.

12. Effectiveness

Should any provision of these Terms and Conditions be or become invalid or conflict with statutory provisions, the validity of the remaining provisions shall remain unaffected. Both parties shall replace the invalid provision with one that most closely approximates the economic meaning and purpose of the invalid provision. The same shall apply in the event of a contractual gap.
